Where Should You Start With Summit County Probate Court?
Use the Summit County Court of Common Pleas — Probate Division. The court is at 209 South High Street in Akron. Its official website provides CASE Records Search, estate and guardianship forms, Local Rules, filing costs, Help Desk appointments, marriage resources and electronic filing instructions.
For an existing case, start with CASE Records Search. For a new estate, determine the correct estate procedure before choosing forms. For eFiling, remember that Summit uses email transmission for eligible documents but does not allow an email filing to commence a proceeding.

How to Search Summit County Probate Court Records
Summit’s online records system has formatting rules that can make a valid case appear missing if the search is entered incorrectly.

Use the official Summit County Probate Court eServices search rather than relying on a private court-record database.
Use the exact case-number format
Case-number searches require an exact match, including spaces and leading zeros. The court gives an example such as 1900 ML 00015.
Use a name for older cases
The court says cases issued before December 29, 1999 may be searched by name only.
Check the document-image limits
Public case types may show document images, but confidential docket entries will not. Some images may also be unavailable online even though the full file is available at Probate Court.
Request certified proof when necessary
Do not use a downloaded online image as a substitute when a bank, agency, employer or another court requires a certified record.
Marriage-license images are not certified copies. Use the Records Room process when legal proof of marriage is required.
Full Administration vs Release vs Summary vs Short Form
Summit County publishes separate instructions for each estate route. Use these figures as a screening guide and verify the actual procedure before filing.
Larger or more complex probate estate
$275 filing feeSummit’s instructions describe full administration when probate assets exceed $100,000 with a surviving spouse, exceed $35,000 without a surviving spouse, or when a wrongful-death/litigation action is filed.
Qualifying smaller estate
$240 filing feeFor more recent estates, Summit’s instructions describe a $35,000 ceiling without a surviving spouse and up to $100,000 with a surviving spouse. Older dates of death have older statutory limits.
Funeral-expense based procedure
$112 with will / $87 withoutSummit says Summary Release may apply when the estate is $5,000 or less and the applicant paid or is obligated to pay the funeral bill, or for a qualifying surviving spouse with assets up to $45,000 and the stated family-allowance/funeral conditions.
Very small estate route
$60 with will / $37 withoutSummit’s Short Form Release instructions state the estate must be worth no more than $4,500 and there must be no unpaid funeral bill.
Do not choose a route solely from the asset amount. The will, surviving spouse, funeral expenses, date of death, litigation, real property and other estate facts can change the correct filing path.
When Summit County Requires the Original Will
Summit’s estate instructions tell filers to provide the original Last Will and Testament when the deceased person had a will. The full-administration instructions also require original signatures rather than copies.
Full administration
Bring or file the original will when the decedent had one.
Release procedures
Release, Summary Release and Short Form instructions also identify the original will when one exists.
Will already deposited?
The Probate Court can retrieve a will deposited in its vault when the estate-opening procedure begins.
Safekeeping option: Summit County allows a person to deposit an original will with the court for a $25 filing fee. A deposited will remains confidential until properly removed or released.
Summit County Probate Court eFiling Is Email-Based
Summit’s electronic-transmission rules differ from probate courts that use a dedicated upload portal. Eligible filings are sent by email to the court.
PDF for filings
Documents are transmitted in PDF format unless the document is a proposed order.
Use Word format
The court says a proposed order should be transmitted in Word format.
Electronic Cover Page required
Include transmission date, sender contact information, case number, caption, document title and page count.
Case number + case caption
The court requires both items in the email subject line.
One case per email
Each email transmission may contain documents for only one case.
Include motion exhibits
Exhibits or attachments to a motion should be filed with the original document.
Official eFiling address: eFiling@summitohioprobate.com. The court says the email address is available 24 hours a day, seven days a week.
What Summit County Does Not Allow by Email Transmission
Do not commence a case by email
A pleading or document necessary to commence a proceeding may not be filed through Summit’s email-transmission system.
Check money on deposit
A fee-required document may not be emailed unless enough money is already on deposit with the court to cover the required cost.
Confidential proceedings excluded
Proceedings deemed confidential cannot be filed through ordinary email transmission.
Check the case balance first: CASE Records includes a Financial tab showing the “Money on Deposit with Court” balance for an existing case.
Summit County Real Estate Transfer Only
Summit County has a separate real-estate-only filing route when the facts fit the court’s requirements.
Six months must pass
The court says at least six months must have passed since the date of death.
Only probate asset is real estate
The procedure is for an estate whose sole probate asset is real property.
No Medicaid Estate Recovery
The decedent must not be subject to Medicaid Estate Recovery under the court’s stated requirements.
Basic filing fee: $100. Additional real-estate transfer charges may apply.

Why Summit Probate Form Packets May Not Open Correctly
Summit County’s forms page contains an unusual technical warning that is worth knowing before you start typing.
Adobe Reader DC recommended
The court says Adobe Reader DC is required for proper filling of its interactive forms.
Browser packet problem
The court warns that Chrome, Edge, Brave and Safari may fail to open some form packets correctly.
Download the packet first
If a packet fails in the browser, download it to the computer and open it directly in Adobe Reader DC.
Freshness check: the official forms page currently lists Local Rules and Rule 5.2 files dated August 14, 2026. Recheck the local rules before filing rather than relying on an older downloaded copy.
Common Summit County Probate Court Costs
3% card charge on many probate filings
Summit’s estate and guardianship instruction pages list a 3% charge when paying those filing fees by credit card.
$10 adversarial motion fee
The court currently states that each adversarial motion filed in a case carries a $10 filing fee.
Accepted payments
The Court Costs page lists cashier’s check, money order, in-state checks, e-checks, cash and credit cards, but not American Express.
Verify the current total immediately before filing. Real-estate transfers and later case activity can create additional costs.

Inventory
Open estates can require an inventory and appraisal of probate assets.
Estate accounts
Fiduciaries may need to file periodic or final account documents before closing administration.

Summit County Adult and Minor Guardianship Basics
Adult guardianship
A Statement of Expert Evaluation from a treating physician, psychiatrist or licensed psychologist is required with the adult application and must meet the court’s timing rules.
BCI check
The court says guardian applicants need a BCI background check; processing can take approximately 3 to 30 days.
More than $25,000
When a minor receives money or property exceeding $25,000, the court says a guardian of the estate must be appointed.
Adult guardianship filing fee
$280, plus the court’s stated credit-card charge when applicable.
Minor guardianship filing fee
$280, with separate fees for minor settlement or dispensing with guardianship.
Original-signature warning: Summit’s guardianship FAQ says original documents are required when signatures are necessary; do not assume a fax or copy is acceptable.

What an Online Probate Image Does Not Prove
Not automatically certified
A web image is not the same thing as a certified Probate Court copy.
Confidential entries
Confidential docket entries do not display downloadable images.
Not every image is online
The court says the entire file may still be available at Probate Court even when an image is unavailable online.
Summit County Marriage License and Certified Marriage Proof
$64 license
The current license fee is $64 and includes two certified copies of the marriage abstract.
5% online card fee
The marriage application page lists a 5% credit-card processing fee.
30 days to appear
After online application/payment, both applicants have 30 days to appear at court for issuance.
License valid 60 days
Once issued, the Ohio marriage license is valid for 60 days.
Both applicants must appear. The court advises arriving no later than 3:30 p.m. so the application can be processed before closing.

Additional certified marriage abstracts are currently $2 each through the Records Room.

Summit County residents who choose to represent themselves can request limited procedural assistance through the Probate Help Desk.
Simple probate matters
The Help Desk can assist with simple estate transfers, review probate forms and answer questions about probate procedures.
Complex legal matters
It cannot assist with making a will, complicated estates, adoption proceedings or contested matters.
Appointment required: call 330-643-2350. There is no Help Desk service fee, although normal court filing fees still apply. Appointments are limited to one visit per case.
