Where Should Wayne County Probate Court Users Start?
Start with the official Wayne County Probate Court website and Case Access. The Detroit court handles decedent estates, wills, guardianships, conservatorships, trusts, mental-health matters and other probate proceedings.
Search the electronic docket before ordering records. If you need to file, use the court’s current filing instructions and “Where Do I File?” routing because Wayne County accepts documents through different departments depending on case type and document type.
Room-number note: the court’s Working Hours page lists 1307 Coleman A. Young Municipal Center for the public court location, while many filing, will and mail instructions direct submissions to Room 1305. Use the specific room shown in the instructions for your task.

How to Search Wayne County Probate Court Cases
Open official Case Access
Use Wayne County Probate Court’s public Case Access system instead of a paid background-search or unrelated Wayne County court website.
Use the case number when possible
WCPC examples use a format such as 2026-123456-DE. Enter the case number exactly as shown on court paperwork.
Otherwise search the full legal name
Case Access can also use first and last name or company name. Search results are limited, so precise spelling helps.
Open the case and check the Docket tab
Review case status, judge, hearings, parties, docket entries, financial entries and available document images.
Order copies only when needed
If the image is unavailable or an institution requires certification, use the official copy-request process.
Older computerized data limit
WCPC says case information before 1976 is not available through the computerized public system.
Older document images
Public images filed before April 1, 2022 generally are not available through online Case Access because of protected-information rules.
Not every image is public
Confidential documents, sealed cases, settlement agreements and certain other records do not appear as public images.
Opening a Wayne County Decedent Estate
The filing path depends on whether the estate is formal or informal, whether there is a will, which person is seeking appointment and whether a small-estate procedure can be used.
Petition route
A formal estate may require a court hearing and formal appointment of the personal representative.
Application route
An informal application may be available in qualifying estates and follows the Probate Register process.
Petition for Assignment
Michigan has a separate small-estate procedure with an annually adjusted estate-value limit.
Use current SCAO and WCPC forms. Wayne County states that when the State Court Administrative Office has approved a form for a probate purpose, that form must be used.
Wayne County Michigan Small-Estate Limit for 2026
For a decedent who died in 2026, WCPC’s current Small Estates page lists a maximum estate value of $53,000 after payment of funeral and burial expenses for the Petition for Assignment procedure.
For qualifying petitions involving real estate filed on or after January 1, 2024, WCPC also lists a $264,000 maximum lien deduction for a 2026 date of death. This is not the same thing as increasing the small-estate limit to $264,000.
2026 estate threshold
$53,000 after qualifying funeral and burial expenses.
Motor-vehicle-only estate
WCPC notes that if the only probate asset is a vehicle, the Michigan Secretary of State may sometimes transfer title without a probate order.
Do not use an older small-estate number. The limit changes by year of death.
Original Will Must Reach WCPC Within 14 Days
If an estate filing involving a will is submitted electronically, Wayne County Probate Court requires a scanned copy in the filing PDF and the original unredacted will must physically reach the court within 14 days.
Include a scan in the filing PDF
The electronic filing packet should contain the scanned copy when a will applies.
Keep the original unredacted will intact
The original is the probate document that must be physically delivered.
Deliver it within 14 days
Use mail, certified mail, delivery service or the court drop box as permitted by current instructions.
Monitor Case Access
Watch the docket and court correspondence to confirm the estate filing continues processing.
Failure to deliver the original will within the required period may result in dismissal of the petition or application.

Wayne Probate Is Not a Normal Automated E-Filing Court
WCPC describes its filing system as a manual electronic process. Documents may be submitted by approved email, fax, mail or court drop box routes depending on the matter.
One complete PDF
Email filings should use one complete PDF attachment for the packet. The court says it cannot accept a picture of the documents as the filing.
Complete document
Fax submissions must contain the complete document rather than sending individual pages as separate transmissions.
Complete packet
Mail and drop-box submissions also need the complete packet and applicable payment instructions.
Processing goal: WCPC currently lists approximately 1-3 business days for document processing after submission and another 1-3 business days for a hearing notice after required filing fees are received.
Do not email a filing to a random WCPC address. Use the current “Where Do I File?” chart because different documents go to different court departments.
Wayne Probate Filing Rejection Checklist
Signature
Every filed document must contain the required signature. WCPC accepts qualifying electronic signatures.
Readable format
Documents must be legible. Body text is generally 12 or 13 point except where an approved form controls.
English language
Court-filed documents must comply with the Michigan court-rule language requirements.
Correct caption
Include the court, case title, case number when applicable, document title, assigned judge and filer information.
Correct form
Use the current SCAO-approved form when one exists and submit required companion forms together.
8½ × 11 view
Documents must be capable of printing at the required page size without manipulation.
Do Not Put Protected Personal Information in Public Probate Filings
Michigan’s protected-personal-information rules affect what appears in public court documents. WCPC specifically warns filers to use the proper separate forms for sensitive identifying information.
Protected information includes
- Date of birth.
- Social Security number.
- Financial account numbers.
- Passport or driver’s-license/state-ID numbers.
Common forms
MC 97 and MC 97a are used for protected personal identifying information when required.
Do not send a copy of a Social Security card to Wayne County Probate Court. The court expressly says it does not require or retain one.
Wayne County Probate Court Filing Fees
Inventory fee can be additional
A deceased estate and small-estate matter can involve an inventory fee based on estate value.
ePayment convenience fee
Online card payment carries a 3.5% convenience fee or $3, whichever is greater.
No out-of-state checks
The court’s fee instructions state that out-of-state checks are not accepted.
Accepted filing fees are not refundable. WCPC says the fee is assessed when the filing is accepted, not according to the later hearing result.
Adult and Minor Guardianship in Wayne County
Legally incapacitated adult
Adult guardianship filings can require the petition, contact information, protected-personal-information forms, acceptance documents and supporting medical information.
Minor guardianship
Full and limited minor guardianships use different forms and notice requirements. Use the case-specific WCPC instructions.
Developmental disability
Guardianship for a person with a developmental disability follows a separate procedure and currently has no petition filing fee.
Important current form: WCPC 262, Guardian’s Financial Disclosure of Ward’s Assets, applies in adult GA and GL cases. The court says a newly appointed guardian must file and serve it within 56 days of qualification.
WCPC also says Form 262 must accompany the Annual Report when the guardian is reporting more cash or property than was previously disclosed.
Conservatorship, Trust and Mental-Health Cases
Conservatorship
Conservatorship matters can involve protection and management of a person’s assets, inventories, annual accounts and Letters of Authority.
Trust matters
WCPC handles registration and supervision of trusts as well as qualifying petitions concerning trust administration.
Mental-health proceedings
Involuntary mental-health proceedings have separate filing, timing, confidentiality and hearing requirements. Do not use a normal estate filing route.
Wayne County Letters of Authority
Letters of Authority are often needed by banks, title companies and other institutions to confirm fiduciary authority.
$12 per Letter
The current court fee schedule lists Letters of Authority at $12.
Electronic certification
Wayne County uses electronic certification rather than a raised seal for current fiduciary Letters.
Annual filing may come first
Updated Letters can depend on first filing a required annual report, account or Notice of Continued Administration.
After the required filing is processed, monitor Case Access for the Letter fee, pay it, then the certified Letter can be issued electronically.
Standard, Certified and Exemplified Wayne Probate Copies
Wayne County Probate Court states that its official records are electronic. Standard, certified and exemplified copies are normally issued electronically.
Check Case Access first
Public images filed on or after April 1, 2022 may already be available online without paying for an ordinary copy.
Electronic court seal
Certified documents use the court’s electronic seal and electronic signatures rather than a raised seal.
For special authentication
Contact the court when another court, out-of-state entity or foreign destination requires exemplification or additional authentication.
Current delay notice: the WCPC homepage notice dated July 15, 2026 says copy requests are experiencing an approximately four-week processing delay. Check the homepage again before ordering.
What Happens After a Wayne Probate Filing Is Accepted?
Pay the filing fee when required
A hearing generally is not scheduled until the filing is accepted and required fees are paid or waived.
Receive the Notice of Hearing
WCPC sends the hearing information, including current Zoom or courtroom instructions.
Serve interested persons
The petitioner is responsible for completing required notice and service.
File proof of service before the hearing
WCPC warns that a hearing may not proceed if required service is incomplete or proof of service has not been filed.
Do not assume the newspaper files your Affidavit of Publication. WCPC specifically says the filer is responsible for submitting proof of publication to the court.
Publication and Unknown-Creditor Notices
Some probate matters require publication. Wayne County Probate Court states that the party or attorney responsible for publication must make sure the Affidavit of Publication is filed with the court.
Arrange publication
Follow the court’s current publication instructions and the applicable notice deadline.
File the proof yourself
Do not assume the newspaper automatically places its affidavit into the probate case.
Emergency Wayne Probate Matters Use a Special Route
WCPC has specific emergency-filing instructions and uses local Form WCPC 96 for situations covered by the current court guidance.
Mark the filing as emergency
If submitting electronically, clearly identify the emergency in the subject line and on the required filing coversheet.
Use the correct department
Emergency estate, guardianship, conservatorship and mental-health matters may route to different WCPC departments.
Emergency label is not automatic approval
The court decides whether the circumstances qualify for emergency handling.
