Summary Release
Form 5.10 begins the Summary Release process and Form 5.11 is the entry granting Summary Release when appropriate.

Extra Lorain County Requirements for Smaller Estate Procedures
Lorain County Local Rule 75.5 adds practical requirements when an estate is being released from administration or handled through Summary Release.
Commissioner may be appointed
The court selects and appoints a commissioner when one is required in an estate released from administration.
Hearing may be waived
The court may waive a noticed hearing when it appears beneficiaries or creditors will not be prejudiced.
Self-represented applicant
A person filing without counsel must display a certified death certificate, photo identification and proof of current address under the local rule.
Do not choose Release or Summary Release only because the estate looks small. Ohio statutory eligibility and Lorain County filing requirements still control.

Application to Probate Will
Form 2.0 is the Application to Probate Will. Related forms include notice, waiver and the Certificate of Service of Notice of Probate of Will.
Will for Deposit
Local Rule 59.2 says a will deposited for safekeeping must be accompanied by Lorain County Form 59.2A. The court provides Form 59.2B as the certificate/receipt for the deposit.
File the will-related application
Use the correct probate or deposit procedure rather than treating every will as an estate-opening filing.
Serve notice when required
Local Rule 59.1 addresses the Certificate of Service of Notice of Probate of Will.
Track the two-month rule
The local rule says the Certificate of Service generally must be filed no later than two months after fiduciary appointment or, if none, after admission of the will to probate.
Important Lorain Probate Filing Rules Before You Submit
8:00 a.m.-4:00 p.m.
Local Rule 53.1 states the Probate Court is open for business Monday-Friday from 8:00 a.m. to 4:00 p.m., except holidays.
4:00 p.m. deadline
Marriage applications and pleadings requiring a new case number or payment of court costs must be filed by 4:00 p.m.
Most fax filings rejected
Local Rule 57.1 says documents are not accepted for filing by fax, except for the limited affidavit-of-mental-illness exception identified in the rule.
Put it on every page
Once a case number exists, the local rules require it on the upper portion of pages that do not bear the case caption.
Original signatures matter
Local Rule 57.4 says filings must contain original signatures unless another local-rule exception applies.
Keep address current
Attorneys and fiduciaries must provide the required current street address and notify the court of a qualifying address change.

A person seeking authority to administer an estate without an Ohio attorney must exhibit current photo identification and proof of current residence and mailing address.
Non-resident fiduciary
A non-Ohio resident seeking appointment must comply with Ohio law and have an attorney of record permitted to practice in Ohio.
Bond or Ohio asset protection
The court may require an Ohio custodial deposit, resident co-fiduciary, bond or another approved arrangement for a non-resident fiduciary.

When Lorain Probate Court Requires a Fiduciary Bond
No personal sureties
Local Rule 75.4 says the court will not accept personal sureties when a surety bond is required.
Bond amount
The rule generally requires the bond to be at least double the probable value of the personal estate and anticipated income during the next accounting period.
